What this page covers
These terms apply to using empyria.io. They are not the terms of a project. If you hire me, the work is governed by a separate written agreement signed by both of us, and where that agreement and this page disagree, the agreement wins.
Using the site
You are welcome to read, quote, and link to anything here. Attribution and a link back are appreciated but not demanded.
What you may not do is scrape the site wholesale, republish substantial parts of it as your own, or use it to train a model you intend to sell. I recognize the irony of a web designer objecting to having their words lifted, but the writing on this site is the product as much as the code is.
What belongs to whom
The design, code, writing, photography and marks on this site belong to EMPYRIA, LLC, except where noted. The Empyria name and triangle mark are used as trade marks.
Client work shown in the portfolio is displayed with the knowledge of the businesses concerned, all of which I own. Their names and marks belong to them.
About the content
Everything here is written in good faith and kept current as far as I can manage, but it is general information about a service, not advice for your specific situation. Prices, timelines and process described on this site are indicative. A quote is a quote only when it is in writing, addressed to you, and signed.
Nothing on this site is an offer to enter a contract, and submitting an enquiry does not create one. A project starts when a written agreement is signed, and not before.
Links out
Where this site links to somewhere else, that is not an endorsement and I have no control over what is there. Follow at your own discretion.
Availability
I try to keep the site up and current. I do not promise it will be available without interruption, and I am not liable if it is not. It is a portfolio, not a utility.
Liability
To the fullest extent the law allows, [ legal entity name ] is not liable for any indirect or consequential loss arising from your use of this site. Nothing here limits liability for anything that cannot lawfully be limited, including fraud or death or personal injury caused by negligence.
Governing law
These terms are governed by the laws of the State of Kansas, and the courts of that state have exclusive jurisdiction.
